ARCHIVED - Over 100 Spanish companies fined for failing to implement new clocking-in law
The re-introduction of clocking in is an effort to prevent unpaid extra hours being worked
When a new law came into force on 13th May obliging all companies in Spain, regardless of size, to keep a register of the times when employees sign in and out of work, it was widely reported that many were finding it difficult or impossible to implement such systems and could therefore be subjected to fines of up to 6,250 euros, and after six months the Ministry of Work has already punished over 100 companies.
At the same time, the review of the clocking-in records kept has led to a further 1,000 fines being levied in relation to excess hours being worked with no overtime payments and other such offences, precisely the kind of offence which the new legislation was designed to prevent.
In terms of failing to comply with the clocking-in register law, 505 investigations have resulted in the detection of 107 irregularities which have resulted in fines totalling 113,181 euros (at an average of a little over 1,000 euros each). At the same time, the number of investigations into unpaid working hours rose by 3.9 per cent but the number of irregularities found has increased by 9.8 per cent, suggesting that the clocking-in law has made it easier to detect unlawful exploitation of workers.
